Проблемы уголовной ответственности за применение запрещенных средств и методов ведения войны

Аннотация

Представлены результаты научно-исследовательской работы, проведенной на материалах судебной практики по преступлениям, связанным с применением запрещенных средств и методов ведения войны. Сформулированы проблемы уголовно-правового описания преступлений, связанных с применением запрещенных средств и методов ведения войны, а также их криминологической профилактики. Приведен исторический очерк развития законодательства по применению запрещенных средств и методов ведения войны. Исследована необходимость преемственности отечественного уголовного законодательства, регулирующего ответственность за преступления данного вида, и предложены направления совершенствования соответствующих юридических норм. Показано значение адаптации уголовного закона для криминологической профилактики применения запрещенных средств и методов ведения войны в современных условиях. Выделены детерминанты преступлений данного вида. Результативность профилактических мер рассмотрена в ретроспективном аспекте и в перспективе интеграции социума освобожденной в ходе СВО территории в российском правовом поле.
Исследована проблема имплементации норм международного права в отечественное уголовное законодательство, регулирующее ответственность за применение запрещенных средств и методов ведения войны. Предложено с целью устранения проблем, связанных с применением несовершенных норм международного права, развивать и конкретизировать содержание диспозиции ст. 356 УК РФ. Приведены результаты анализа и обобщения судебной практики. Ввиду отказа от сотрудничества недружественных стран предложено в профилактике применения запрещенных средств и методов ведения войны опираться на отечественные судебные органы и другие государственные структуры. С учетом тенденций видоизменения преступлений, связанных с применением запрещенных средств и методов ведения войны, намечены направления дальнейших исследований.
