Психолого-криминологический анализ теорий отказа от преступной деятельности постпенитенциарной личностью
Аннотация
В статье предлагается ретроспективный и современный психолого-криминологический анализ основных теорий отказа от преступной деятельности. В отличие от традиционной фокусировки на детерминантах преступности, подчеркивается важность понимания отказа от преступной деятельности как многофакторного процесса, связанного с трансформацией криминальной идентичности постпенитенциарной личности. В результате исследования установлено, что успешная реинтеграция лиц, освободившихся из пенитенциарных учреждений, требует комплексного понимания отказа от преступной деятельности, учитывающего как субъективные (индивидуальные), так и социальные (социальные связи) факторы, а также применения психосоциального подхода для эффективной декриминализации постпенитенциарной личности. В статье также рассматриваются проблемы, возникающие при применении зарубежных теорий в отечественной практике постпенитенциарной пробации и необходимости разработки интегративной теории отказа от преступной деятельности. Рассматривая перспективы будущих исследований, автор статьи предлагает разработку четких операциональных определений и индикаторов отказа от преступной деятельности. Это может включать в себя разработку стандартизированных инструментов оценки, учитывающих как объективные, так субъективные показатели криминогенных рисков. Исследования в этой области могут помочь в разработке новых концепций и проектировании эффективных индивидуальных программ социальной адаптации, ресоциализации и социальной реабилитации, направленных на оказание постпенитенциарной поддержки лицам, освободившимся из пенитенциарных учреждений.
